These terms apply to your use of tivawholesalers.co.za and to goods you buy from TIVA Wholesalers ("TIVA", "we", "us"). By using the site or placing an order you agree to them. Our privacy policy and returns and refunds policy form part of these terms.

Using the website

The site is provided for information about our wholesale range and to request quotes. Information on it is general and may change without notice. Please do not misuse the site, attempt to disrupt it, or submit false information.

Quotes and orders

• A quote is an invitation to order, not a binding offer. Prices are for the quantities and products stated and are valid for the period shown on the quote, or if none is shown, for seven days.
• Prices and availability can change with supplier costs and stock. Prices exclude VAT unless stated.
• An order is only accepted when we confirm it in writing (email or invoice). We may decline an order, for example where stock is unavailable or a pricing error is found, and will tell you promptly.

Trade accounts and payment

Trade accounts are opened at our discretion. Payment terms are as agreed with you in writing. Unless we have agreed credit terms, orders are paid for before collection or delivery. We may charge interest on overdue amounts and recover reasonable collection costs where the law allows.

Delivery and collection

Delivery times we give are estimates, not guarantees. Please check goods on delivery or collection. Risk in the goods passes to you when they are delivered to your premises or collected, and ownership passes once we have received full payment.

Liability

To the extent the law allows, we are not liable for indirect or consequential loss, or for loss of profit, arising from use of the site or from goods supplied, and our total liability for any order is limited to the price you paid for the goods concerned. Nothing in these terms excludes liability that cannot be excluded by law, and nothing limits your rights under the Consumer Protection Act 68 of 2008 where it applies to you.

Intellectual property

The TIVA name, logo and the content of this site belong to TIVA Wholesalers. Please do not copy or reuse them without our written permission.

General

These terms are governed by the laws of South Africa and the courts of Gauteng have jurisdiction. If any part is found unenforceable the rest remains in force. We may update these terms and will change the effective date above when we do. Orders are governed by the terms in force when the order is placed.
